Terms of Service

1. About the service

SmartShopAgent is an online service that lets shopkeepers and restaurant owners create, for free, a public web page presenting their business: name, address, opening hours, phone, description and photos. A QR code is generated automatically for each page.

The service is published and operated by SmartShopAgent, reachable via the contact page.

2. Acceptance of the Terms

Using the service implies full and unreserved acceptance of these Terms of Service. If you do not accept these terms, you must not use the service.

3. Registration and account

To create a page, you must create an account by providing a valid email address and a password. You are responsible for keeping your credentials confidential. Any login made with your credentials is deemed to be made by you.

You undertake to:

• Provide accurate, up-to-date information when registering
• Verify your email address within the allotted time (link valid for 10 minutes)
• Notify SmartShopAgent of any unauthorised use of your account

SmartShopAgent reserves the right to delete any account whose email address has not been verified within a reasonable time.

4. Use of the service

The service is intended for shopkeepers, restaurant owners and professionals wishing to present their business online. It is forbidden to use the service to:

• Publish unlawful, defamatory, hateful content or content contrary to public order
• Impersonate a third party or another business
• Publish photos that do not belong to you or for which you do not hold the rights
• Spam, harass or harm other users
• Attempt to compromise the security of the platform

5. User content

You retain ownership of all content (text, photos) you publish on your page. By publishing it, you grant SmartShopAgent a non-exclusive, free, worldwide licence to display it as part of the service.

Photos are subject to the following rules:

• Allowed formats: JPG, PNG, WebP, GIF
• Maximum size per file: 5 MB
• Maximum number of photos per page: 20

6. Service availability

SmartShopAgent strives to keep the service available 24/7. However, interruptions may occur for maintenance, updates or in the event of force majeure. SmartShopAgent does not guarantee uninterrupted availability of the service.

7. Free of charge and pricing changes

The service is currently offered free of charge. SmartShopAgent reserves the right to change its pricing model. Should a paid offer be introduced, existing users will be informed beforehand by email with reasonable notice.

8. Termination

You may delete your account at any time, directly from your dashboard (the “Delete my account” button) or via the contact page. Deletion entails the removal of your public page and all associated data.

SmartShopAgent may suspend or delete an account in the event of a breach of these Terms, without notice or compensation.

9. Limitation of liability

SmartShopAgent is provided "as is". To the extent permitted by law, SmartShopAgent cannot be held liable for indirect damages, data loss, loss of business or loss of customers resulting from the use of, or inability to use, the service.

10. Intellectual property

The SmartShopAgent platform, its design, its code and its own content are the exclusive property of SmartShopAgent and are protected by French and international intellectual-property law. Any reproduction without authorisation is prohibited.

11. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the competent courts are those of Paris.

12. Changes to the Terms

SmartShopAgent reserves the right to modify these Terms at any time. Users will be informed by email of substantial changes. Continued use of the service after notification constitutes acceptance of the new terms.
